Planning conditions and obligations
Local planning authorities (LPAs) can impose conditions on the grant of planning permission to regulate the development or use of any land in the applicant's control or requiring the carrying out of works on that land.
There are policy tests for these conditions and LPAs have a duty to give reasons for their decisions. Practical considerations include timing, section 106 agreements, and the discharge of obligations. The commentary deals with the position in England. In Wales, different planning policies and law may apply.
