A mortgage valuation was commissioned by a company which the valuers believed to be the intended lender, when in reality that company was acting as an agent for the true lender. It was held that, as far as the tort of negligence was concerned, the valuers owed no duty of care to the lender, of whose existence they were completely unaware. (This decision appears to be in direct conflict with that in Nightingale Finance Ltd v White & Co.)
