Rights of light case law
Rights of light is complex area – a subject notorious for generating friction between building owners or occupiers. A right to light can be acquired by express grant or reservation, implied grant, implied reservation or prescription. It can be extinguished by a number of means.
Infringement of rights can lead to litigation, with remedies being abatement and declarations, injunctions or damages. High hedges can be a particular issue in relation to neighbours.
