Summary

A valuer who was instructed to value the timber on an estate did so on an entirely erroneous basis, in that he included saplings where he should not have done so. As a result of this negligence, the valuation was inaccurate by almost 50% and so of no use to the client. It was held that the valuer was not entitled to his agreed fee.
