Summary

The defendant surveyors were retained to represent the claimant property owner in compulsory purchase negotiations. Shortly before these negotiations began the Court of Appeal handed down a decision which altered the law as to the date on which property should be valued for the purposes of compulsory purchase. Before the negotiations ended, this new ruling was confirmed by the House of Lords. The change in the law would have favoured the claimant, but the defendants agreed on his behalf a figure that was clearly based on the old law. They were held to have been negligent in failing to keep their relevant legal knowledge up to date.
