Summary

The defendants were instructed by the claimant lenders to carry out a mortgage valuation of industrial premises (a newly-built unit in a commercial centre) on the basis of a 90-day sale by a mortgagee in possession. The valuer concluded that, given the evidence of local demand and recent transactions, the value of the property on this basis was exactly the same as its open market value. The Court of Appeal upheld the trial judge's finding that the valuer had not been negligent in coming to this conclusion.
