The defendant surveyors, who were acting on behalf of a tenant at a rent review hearing, negligently failed to draw certain relevant evidence to the attention of the arbitrator. It was nevertheless held that they were not liable to their client, since the court was satisfied that, even if the evidence in question had been presented to the arbitrator, he would have reached exactly the same decision as to the rent.
