In carrying out a building survey for the potential purchaser of a farmhouse, the defendant surveyor accepted the vendor's word that the property had mains drainage (when in truth it had a septic tank). This was held not to have been negligent, since such information would normally be ascertained through a preliminary enquiry between solicitors. Moreover, to check the destination of the drainage would require a special test, something which the purchaser had been offered and had declined.
