Summary

This case, decided before Smith v Eric S Bush, concerned the purchase by the claimant (who was an estate agent) of a property that comprised 2 shops, a maisonette and a flat. It was held that a disclaimer of responsibility by the mortgage valuer was fair and reasonable, apparently because the property was not simply a modest residential one and because the purchaser was someone who would be familiar with this type of disclaimer and with the range of surveys and valuations available.
