Summary

The defendants, in carrying out a mortgage valuation of a house that had been converted from a bakery, noticed that a chimney breast in the kitchen had been removed and checked the room above for signs of distress (of which there were none). The Court of Appeal held that the surveyor had been negligent; had he looked inside the cooker hood or kitchen cupboards (something which he would not normally be expected to do on a limited inspection of this kind), he would have realised immediately that the work had been 'botched' and the chimney left with inadequate support.
