Summary

A property developer, having completed the conversion of a house into 3 flats, commissioned an inspection of the floorboards and under-floor timbers of the ground floor flat from a dry rot surveying specialist, making it clear that he wanted a report that he could show to prospective purchasers. It was held that the surveyor, who negligently reported that there was no evidence of dry rot, owed a duty of care to the purchasers of the ground floor flat. However, no duty was owed to the purchaser of the flat above, who was shown the surveyor's report and concluded from it that this flat must also be free from dry rot.
