In contrast to Private Bank & Trust Co Ltd v S (UK) Ltd, the defendants here were held negligent in the carrying out of a residential mortgage valuation because they had clearly failed either to realise or to take account of the fact that the residential property market 'had come off the boil and was falling'. The judge held that a bracket of 15% should be adopted.
