Summary

The claimant, who wished to purchase a small shop and retail greengrocery business, sought a mortgage loan from a bank. The bank instructed the defendant to value the property and business and, when this had been done, showed the purchaser a copy of the valuation and report. The valuer was held liable to the purchaser for a negligent valuation, on the basis of the principle laid down in Smith v Eric S Bush. The judge decided that this principle was applicable, even though the case concerned commercial rather than residential property, because of the modest value of the property involved.
