Irrespective of the principles outlined above, a 'non-speaking' valuation by an independent expert, once made, is extremely difficult to challenge. It was said by the Court of Appeal in this case, which concerned an option to purchase land at a price to be determined by an independent expert, that a court should give no encouragement to any attempt to infer, from the decision given, what the basis of that decision must have been, and then to argue that this basis was legally incorrect.
