Citation
41 EG 87, CA
Keywords
Negligence in valuations and surveys
Summary

The defendants carried out a full building survey for the claimant purchasers of a pre-war bungalow in Cornwall. They were held negligent for failing to detect and report on the fact that the outer walls of the property, like others in the locality, were built of blocks of cement and a particular type of aggregate. This aggregate consisted of mine waste or 'mundic', a substance that was by then known to be liable to deteriorate and eventually crumble.
