Summary

The defendant, who was appointed to act as an independent expert in carrying out a rent review on a unit in a shopping centre, adopted a method of valuation which had been approved in a previous decision of the Court of Appeal. The landlord argued that this method was in fact incorrect, and the trial judge agreed that this was so. Nevertheless, the defendant was held not to have been negligent, in that a reasonably competent valuer could not be expected to contradict existing case law.
