Cases - Goodwin v Phillips

Record details

Name
Goodwin v Phillips
Date
(17 June 1994, unreported)
Keywords
Negligence in valuations and surveys
Summary

Awards of damages under this heading are normally extremely modest in amount. This case is noteworthy in that the claimants, a diabetic husband and his wheelchair-bound wife, who purchased a house in reliance on a negligent mortgage valuation which failed to reveal that the property was of unconventional construction and in extreme disrepair, received £12,500 (a considerable sum at the time). The size of the award was based on the extreme physical inconvenience suffered by the claimants over a period of more than 2 years in the seriously defective house, followed by a further 4 years in unsuitable alternative accommodation, namely a mobile home.
