Following the House of Lords' ruling in the Nykredit case, it was held in a case involving a residential mortgage that the value of a borrower's covenant to repay is simply a question of fact. Here, although the borrower had not yet defaulted, the judge held that the covenant to repay should be valued at less than £10,000, a ruling which the Court of Appeal refused to disturb.
