Summary

In this case, the vendor sold milk quota using a grazing agreement. Subsequently, when it became apparent that the purchaser had failed to graze stock on the land during the term of the agreement, the vendor applied for the re-registration of the quota in his name.

It was held that the effect of Council Regulation 1371/84 (as amended) was to require actual occupation of the land, and not the acquisition of a mere right to occupy.
