Summary

An agent's clerk, acting within the scope of his employment, told the intending tenant that he could use the premises as a music academy. In fact this use was in breach of covenant. Neighbours complained about the noise, so the landlord brought an action against the tenant for breach of covenant. This action failed because of his agent's misrepresentation, but the landlord succeeded in recovering the costs from his agent for breach of duty.
