Summary

The plaintiff estate agent was appointed sole agent for the sale of the defendant's property. Mr Justice Swift found the contract to be that the plaintiff should not only be appointed sole agent, but also that he should receive a commission whether he introduced the purchaser or not. He said:

'If two men, A and B, like to make a bargain that A shall pay B £500 if A's estate is sold, whether B has anything to do with the selling of it or not, then, if the estate is sold, A must pay.'

In an action for commission, judgment was given for the plaintiff.
