Summary

In this case the agent charged the equivalent of 1 week's rent in the event (a) of the agent finding acceptable accommodation and (b) of the client actually becoming the tenant of such accommodation. The agent would provide an address or addresses for the client to view, but no money would change hands unless the client obtained accommodation. The House of Lords held that the transaction was lawful, as the consideration was for finding accommodation, not for supplying addresses. The case of McInnes v Clarke was distinguished.
