Summary

The agents were instructed by the defendant 'to find someone to buy my house'. A person was introduced who signed an agreement subject to formal contracts being drawn up. The defendant then withdrew from the transaction.

The Court of Appeal held that 'find someone to buy' meant 'find a purchaser'. Therefore commission was only payable when a binding contract for sale had been entered into.
