Summary

The agent noted an agreed variation in his commission charges on the back of a business card and signed it. Although what he wrote did not clearly accord with the actual variation orally agreed with the client, the agent was held not to be in breach of section 18 because, at the time the event occurred, the Estate Agents (Provision of Information) Regulations 1991 had not come into effect and it was not necessary to put the information required by section 18 in writing. Today, of course, the agent would be in breach.
