The tenants had failed to carry out building works at the property by the agreed date. They had also failed to give the landlord notice of a mortgage that they had created over the property.

These were both breaches of covenant. Were they capable of remedy? The Court of Appeal held that they were.

The question is simply whether the harm to the landlord would effectively be remedied by compliance with the section 146 notice within a reasonable time of the notice, together with monetary compensation. Here, the harm would be remedied by compliance even if late.
