Summary

The defendant appointed the plaintiffs his 'sole agents for the sale of the property' for a period of 6 months. The defendant found a buyer himself. The buyer had had no contact with the plaintiffs, and was not even aware that they were the agents.

The court held that clear words are required to confer the sole right to sell. The words in the contract only conferred sole agency, and there was no implied term to the effect that the defendant could not sell the house himself. Therefore there was no breach of contract.
