Summary

A sole agency agreement was entered into between the parties. It provided for an initial 3-month period which was to be continued after expiry of the 3 months until terminated by 14 days' written notice by either party. During the continuation period, a potential purchaser saw the claimant agent's advertisement and was shown around the defendant's property. The purchaser employed an acquaintance as a middleman between himself and the defendant. The middleman conducted viewing and negotiations which brought about the eventual sale.

The agent claimed commission and the court awarded it. The fact that the purchaser used the services of the middleman did not undermine the agent's introduction. To the contrary, it arguably reflected the efficacy of the introduction.
