In this case about the repainting of a listed building in deep pink with black detailing, Mr Justice Mann said:

'I would regard the painting or the repainting of the building as being an operation normally undertaken by a person carrying on business as a builder. Accordingly, and subject to the provisions of the permission granted by the Town and Country Planning General Development Order 1977 and subject also to the painting or repainting affecting the external appearance of the building ..., it would constitute "development".'
