In his decision letter, a planning inspector concluded that he was not satisfied that there was sufficient evidence to show 'beyond all reasonable doubt' that the appeal property had remained in use as a guest house over the relevant period. So he upheld the notice.
The High Court held that the standard of proof is the civil standard of the balance of probability. The use of the phrase 'beyond reasonable doubt' was the criminal standard and so the decision would be set aside.
