Summary

Land was used for grazing non-agricultural horses. This was held to fall within the meaning of 'use of land as grazing land' because, unlike the words 'breeding and keeping of livestock', there was nothing in the definition limiting it to animals used for the purposes of farming. The Court noted that whether land is primarily used as grazing land is a question of fact. Just because horses happen to graze on a piece of land does not make it grazing land if they are fed primarily by other means. (See, for example, Fox v First Secretary of State (2003) where racehorses were grazed but were also supplied with food.)
