Summary

The appellants owned land on which 27 wooden self-built chalet-type dwellings had been erected by licence. They remained in the ownership of the licensees and so were not part of the realty.

Lord Justice Mann said that it was 'obvious' that the chalets were buildings. Incorporation into the realty is but one factor and not determinant either way. Having regard to the degree of permanence of the chalets and the effect on the physical quality of the land, it was common sense that the chalets were buildings for the purposes of planning law.
