In this case Mr Justice Keene set out the legal principles applicable to the use of extrinsic material in construing a planning permission. He observed that when recourse is had to the planning application in resolving a particular ambiguity in the permission, this does not mean that the whole application is thereby incorporated into the permission. That would be contrary to the rule in Miller-Mead.
