In a case concerning the refusal of permission for 2 retail warehouses to sell certain goods, the appellants claimed that mere fear or a generalised concern of a precedent effect was not enough. The judge agreed, but was satisfied that there was evidence in this case. He said:

'There must be evidence in one form or another for the reliance on precedent. In some cases the facts may speak for themselves. For instance in the common case of the rear extension of one of a row or terrace of dwellings it may be obvious that other owners in the row are likely to want extensions if one is permitted. Another clear example is sporadic development in the countryside.'
