Summary

The appellant used a garage for the repair of his car and occasionally his friends' cars. On being made redundant he started repairing cars on a full-time basis. It was held that although mere change from part-time to full-time could not be material, there was a change in character of the use from dwellinghouse and ancillary garage to dwellinghouse and commercial garage. This entitled the Secretary of State to conclude that there had been a material change of use.
