A party structure notice was not served properly in accordance with the 1996 Act. A notice, falsely dated 5 July 2001, was faxed to the adjoining owner's surveyor, who had no authority to receive such a notice, over a month later. The award was signed 2 days afterwards. It was held that the surveyors 'award' which falsely recited the date of service of the structure notice was invalid.
