Summary

The case concerned a challenge to a compulsory purchase order under the Acquisition of Land Act 1981. The application to court must be made within 6 weeks from the date on which the order is first published - a provision equivalent to the one in section 288 of the Town and Country Planning Act 1990. It was held that this means that if the order were published on a Monday, the six weeks would begin on the next day (Tuesday) and expire at the end of the Monday in 6 weeks' time. The Tuesday following would be a day late. The corresponding date rule, applicable to months because of their different lengths, does not apply.
