Summary

A double-fronted house with a matching pair of large, prominent bay windows was changed from office to retail. A planning inspector determined that the change was permitted development within class D of the GPDO and the planning authority appealed.

The inspector's approach was upheld in the High Court. There was no requirement that a display be designed as such and the inspector had considered such matters as sill heights, window area and glazing bars. It was impossible to say that his conclusion that they were display windows was unreasonable.
