Summary

From 1952 to 1964 residential premises had been leased to the United States Government for use by its air force. The premises had a high security use including use as a signals unit, but it had been put to administrative purposes also. In his decision, Mr Justice Goff stated that:

'... one must look at the unit as a whole and see what is the predominant nature of the user.'

In applying this test, he found on the facts that the receiving and sending of secret messages was not the predominant use, and that the premises were an administrative unit for military purposes. The premises therefore fell within the meaning of 'office for any purpose' within Class II of the Town and Country Planning (Use Classes) Order 1963.
