The Secretary of State's decision letter was dated 8 December 1980 but was not received until 13 December. The application to the High Court was made on 22 January. The Secretary of State therefore contended that it was out of time. The appellant claimed that no person could be 'aggrieved' until he had notice of the decision, and so his application was not out of time.

The House of Lords held that the relevant action is taken on the date stamped on the decision letter. This is consistent with other statutory references to decision making as distinct from giving notice.
