Summary

The local planning authority sought an injunction to restrain Gladden from erecting various large replica items on and about his house in a personal battle with the council. An issue arose as to whether the erection of a large wooden replica of a Spitfire could be 'enjoyment of the dwellinghouse as such'. Following Wallington v Secretary of State for Wales it was held that the personal pleasure Mr Gladden derived from putting one in the eye of the council is not enjoyment of the dwellinghouse as a dwellinghouse.
