Summary

The appellant occupied a cottage within 4.5 acres of gardens. There were well-cut lawns near the dwellinghouse and rough grass, largely neglected, over the rest of the grounds. The appellant erected a summerhouse, without planning permission, in the rough part of the gardens. The High Court upheld the inspector's finding that the building was not on land that could be described as part of the curtilage, as the land on which it stood did not serve the dwellinghouse.
