Summary

Planning permission for a building permitted the western half to be used for offices and the eastern half for flats. After the building was erected the respondents sought planning permission to change the use of the flats to offices. Permission was refused, principally on the ground that such a change would result in the loss of residential accommodation of which there was a shortage.

The Court of Appeal held that the need for housing was a material consideration upon which the Secretary of State was entitled to base his decision.
