This House of Lords decision overturned decisions of the Lands Tribunal and the Court of Appeal and held that the Pointe Gourde principle has no application when making judgments on planning assumptions under sections 14-17 of the Land Compensation Act 1961.

Section 14(3) allows potential development value to be taken into account but this cannot become an assumed planning permission.
