Summary

The House of Lords had to consider a decision of a local authority to resolve to make a CPO. The Council reached its decision in favour of an operator on the basis that finance would be available for work on another site in the City. The Court quashed the decision on the basis that when dealing with compulsory purchase the principle to be applied relating to material considerations must be applied strictly to the order land in view of the serious invasion of property rights involved in compulsory acquisition.
