Summary

The Upper Tribunal, in a preliminary issue hearing, held that in principle it was possible for a claimant to seek compensation under the second limb of Rule 6 of section 5 of the Land Compensation Act 1961 for lost rents that would have been received on both land acquired and retained land for which planning permission had been granted but where implementation was delayed and then cancelled due to the scheme. However, the Tribunal warned of the evidential difficulties that were likely to arise in procuring the claim and the matter was eventually settled without issues of causation being examined.
