This case concerned a legal challenge to a general vesting declaration. It was argued that the scheme, which had been the subject of the CPO, was no longer viable and that the general vesting declaration had been made in respect of a different scheme. The Court disagreed in this instance as both proposals involved regeneration of the town centre. However, the Court said that there could be circumstances where the Court would quash a general vesting declaration if the scheme was different.
