Summary

This case concerned a CPO in respect of a house owned jointly by a husband and wife. When the order was made, a statutory notice was only served on the husband and not the wife. Subsequently, the wife sought to quash the order on the basis that she had not been served. While the Court found as a matter of fact that the wife had not been served, it declined to exercise its discretion to quash the order, on the basis that she had known about it and had not been substantially prejudiced.
