Summary

In this case, the acquiring authority was seeking a clearance order in order to demolish some buildings and then construct a replacement building. The argument was put forward that the cost of demolition and rebuilding as proposed by the acquiring authority was greater than the cost of repair and rehabilitation of the existing properties. The secretary of state and the inspector considered that the comparative costs were irrelevant. The Court of Appeal disagreed and quashed the order.
