This case involved an allegation of bad faith. It was alleged that an acquiring authority had made a CPO against the applicant's land in order to protect its own market. On the particular facts of this case, the Court found that the history of the relationship between the applicant and the Council gave rise to suspicions over the motives of the Council, which were more than a mere assertion.
