Summary

The appellant was a quantity surveyor employed by Monmouth County Council. During the period of his employment, considerable building works took place and a particular building firm secured a number of contracts from the local authority. It transpired that the firm in question had received substantial overpayments as a result of the appellant's approval of excessive quantities and prices in some of the contracts. The contractor subsequently went into liquidation.

The court held that the quantity surveyor was under a duty to ensure rates that were excessively high were not accepted, even though the appellant was under considerable pressure to carry through the contracts to completion. He was held liable for the overspend.
